1. Acceptance of Terms

By accessing or using PicGlobe (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and WEBXO TECH LTD (Company No: 17178615), registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, UK.

2. Description of Service

PicGlobe provides a platform for users to upload, store, and share images (the "Service"). Key features include:

• Image upload and storage on Cloudflare R2 infrastructure
• CDN-powered image delivery via i.picglobe.org
• Shareable links (Direct, BBCode, HTML, Markdown)
• Expiry options (1 hour to Forever)
• Premium subscription plans with enhanced features

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts & Registration

Guest Users: You may upload images without creating an account. Guest uploads are subject to standard rate limits and retention policies.

Registered Users: To access additional features (dashboard, premium plans), you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept all risks of unauthorised access
• Notify us immediately of any security breach at security@webxo.tech
• Be responsible for all activities that occur under your account
• Not share your account credentials with any third party

4. Acceptable Use Policy

You agree NOT to upload, store, or share any content that:

• CSAM (Child Sexual Abuse Material) — ZERO TOLERANCE Immediate reporting to IWF and NCA CEOP
• Violates any applicable law or regulation (UK, EU, or local)
• Infringes copyright, trademark, or other intellectual property rights
• Contains malware, viruses, or malicious code
• Is defamatory, harassing, abusive, or threatening
• Depicts non-consensual intimate imagery (NCII / revenge porn)
• Promotes terrorism, extremism, or violence
• Contains doxxing or personally identifiable information without consent
• Is used for phishing, fraud, or deceptive practices
• Exceeds permitted rate limits or attempts to bypass restrictions

5. User Content & License Grant

You retain all ownership rights to the images you upload. By uploading content to PicGlobe, you grant WEBXO TECH LTD a non-exclusive, worldwide, royalty-free license to:

• Store, cache, and deliver the content via our CDN
• Generate thumbnails and optimised versions for delivery
• Analyse content for abuse prevention (automated scanning only)
• Remove or disable access to content that violates these Terms

This license terminates when you delete your content or your account, unless the content has been shared publicly and cached by third parties.

6. Prohibited Conduct & Enforcement

We reserve the right to investigate and take appropriate legal action against anyone who violates these Terms, including:

• Removing or disabling access to violating content
• Issuing warnings or suspending accounts
• Terminating accounts after three (3) valid strikes for repeat infringements
• Blocking IP addresses of persistent violators
• Reporting illegal content to law enforcement (CSAM, terrorism)
• Pursuing legal action for damages or injunctive relief

7. Premium Subscriptions & Payments

Premium Plans: PicGlobe offers paid subscription plans (Premium, Business). By purchasing a subscription, you agree to:

• Pay all applicable fees as described on our pricing page
• Provide accurate billing information
• Authorise us to charge your payment method (via Stripe) on a recurring basis
• Subscribe for a minimum period of 30 days (monthly plans) or 12 months (annual plans)

Cancellation & Refunds: You may cancel your subscription at any time via your dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or unused time unless required by UK consumer law.

Price Changes: We may change subscription prices with 30 days' notice via email. Continued use after price changes constitutes acceptance.

8. Intellectual Property Rights

The PicGlobe name, logo, website design, and all non-user content are the exclusive property of WEBXO TECH LTD. You may not:

• Copy, modify, or distribute our branding or website code without permission
• Use our trademarks in a way that confuses users or implies endorsement
• Reverse engineer, decompile, or attempt to extract our source code
• Create derivative works based on the Service

9. Limitation of Liability

To the maximum extent permitted by English law, WEBXO TECH LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, revenue, data, or goodwill
• Loss or corruption of uploaded images
• Unauthorised access to or alteration of your content
• Third-party claims arising from your use of the Service
• Service interruptions, delays, or errors

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information obtained through the Service
• Warranties that images will remain available for any specific duration

We do not guarantee that images will be stored permanently. Users are strongly advised to maintain their own backups of important content. While we target 99.9% uptime for Premium users, free service is provided without availability guarantees.

11. Data Retention & Deletion

Guest Uploads: Images uploaded without an account are retained according to the expiry setting selected at upload (1 hour to Forever). IP addresses are retained for a maximum of 30 days per UK GDPR.

Registered Users: Account data is retained while your account is active. Upon account deletion, we will delete your data within 30 days, except where retention is required by law (e.g., payment records for 7 years).

Image Deletion: You may delete your images at any time via the dashboard (registered users) or by using the delete function on result pages (guest users). Deleted images are removed from our CDN and storage immediately.

12. Termination

By You: You may terminate your account at any time via your dashboard settings. Your images will remain subject to their expiry settings unless manually deleted.

By Us: We may suspend or terminate your access to the Service immediately, without notice or liability, for any reason, including:

• Violation of these Terms or our Policies
• Repeat copyright infringement (3 valid DMCA strikes)
• Upload of illegal content (CSAM, terrorism, NCII)
• Attempts to breach our security or rate limits
• Non-payment of subscription fees (Premium users)

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

For disputes involving Premium subscribers, we encourage informal resolution by contacting legal@webxo.tech prior to litigation.

14. Modifications to Terms

We may revise these Terms from time to time. Material changes will be communicated via:

• Email notification to registered users (30 days' advance notice where practicable)
• Notice on our website (banner or popup)
• Updated "Last updated" date at the top of this page

Your continued use of PicGlobe after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.
